Accelerated Examination for Japanese Trademark Applications
― Securing trademark rights quickly before launch, exhibitions, licensing, or enforcement ―
When launching a brand in Japan, the ordinary trademark examination timeline may not fit your business schedule. Product launches, trade shows, distributor negotiations, licensing discussions, crowdfunding campaigns, and anti-counterfeiting measures often require earlier legal certainty.
In such cases, applicants should consider accelerated examination for Japanese trademark applications. This system allows eligible applications to be examined earlier than ordinary cases, provided that the applicant submits a written explanation and appropriate evidence.
MEVRO International IP Services has extensive hands-on experience with accelerated examination for Japanese trademarks. We do not merely prepare forms; we structure the evidence so that the applied-for mark, designated goods/services, actual use or preparation for use, and the user of the mark are clearly connected.
1. What is accelerated examination?
Accelerated examination is a request-based system for trademark applications that require earlier examination. The applicant or its representative files a “Written Explanation of Circumstances Concerning Accelerated Examination.” No official fee is charged by the Japan Patent Office for filing the request.
According to the JPO’s 2026 Status Report, in 2025 the average period from the request for trademark accelerated examination to the first examination result was 1.9 months. However, accelerated examination does not guarantee registration, and an application may not be selected if the requirements or evidence are insufficient.
The JPO’s “fast-track examination” for trademarks was suspended after FY2022, and the timing of any restart has not been determined. For urgent trademark matters, applicants should consider the request-based accelerated examination system.
2. Main types of eligible applications
Under the current JPO practice, eligible applications generally fall into the following categories.
| Category | Outline | Typical situations |
|---|---|---|
| Type 1 | The applicant or licensee already uses the applied-for mark, or has made substantial preparations to use it, for some designated goods/services, and urgent rights acquisition is required. | Unauthorised third-party use, warning letters, licensing requests or licences, foreign filings, or a plan to use the Japanese application as a basic application for a Madrid filing. |
| Type 2 | The application designates only goods/services for which the mark is already used or for which substantial preparations for use have been made. | A focused application limited to the actual business scope. |
| Type 3 | The applicant already uses, or has made substantial preparations to use, the mark for part of the designated goods/services, and the application designates only goods/services listed in the official examination standards and related references. | A case where evidence covers part of the specification while the wording of goods/services is aligned with official standards. |
The appropriate category depends on the wording of the designated goods/services, the actual use or preparation for use, foreign filing strategy, licensing status, and the existence of third-party conflicts.
3. Evidence is the key
The core of an accelerated examination request is evidence. The evidence must objectively show that the applied-for mark is already in use, or that substantial preparations for use have been made.
At minimum, the following three points should be clearly connected:
- The user is the applicant, a licensee, or a qualifying related party.
- The mark in use is identical to the applied-for mark.
- The mark is used for the designated goods or services.
Submitting screenshots or product photos alone may not be enough. It is often necessary to explain which part of the material shows the mark, who is using it, and which goods or services are involved.
For “substantial preparations for use,” a mere internal plan is not sufficient. Useful evidence may include purchase orders, accepted production orders, draft catalogues, signboard designs, website production orders, or other materials showing that the business has objectively moved toward use of the mark.
4. When should you consider accelerated examination?
- When the product or service launch date in Japan is approaching
- Before trade shows, exhibitions, crowdfunding, or e-commerce launch
- When unauthorised use or imitation by a third party is suspected
- Before distributor, dealer, or licence negotiations
- When the Japanese application will support foreign filings or a Madrid Protocol filing
- When investors, business partners, platforms, or online marketplaces request proof of trademark protection
5. How MEVRO can assist
MEVRO International IP Services supports Japanese trademark accelerated examination from the filing strategy stage.
- Assessing whether accelerated examination is available
- Designing or adjusting the goods/services specification
- Organising evidence such as product photos, catalogues, EC pages, websites, SNS posts, and press releases
- Preparing Japanese explanations or translations for foreign-language materials
- Clarifying relationships where use is made by a licensee, affiliated company, distributor, or controlled entity
- Preparing and filing the Written Explanation of Circumstances Concerning Accelerated Examination
Accelerated examination is not simply a matter of collecting documents. The practical issue is whether the evidence clearly connects the mark, the designated goods/services, the user, and the actual use or preparation for use. Based on our extensive experience, we assist clients in presenting their case effectively and efficiently.
6. Conclusion
Accelerated examination can be a valuable tool when trademark rights in Japan are needed quickly for business reasons such as product launches, exhibitions, enforcement, licensing, distributor negotiations, or international filings.
Whether a request will be accepted depends on the specification, the status of use or preparation for use, and the quality of the evidence. If you are planning to launch a brand in Japan, it is advisable to consider accelerated examination before or immediately after filing.
